I- SUBJECT
Subject of this agreement is to specify the rights and obligations of the parties relating to the sale and execution of the activity service which is offered by Zakkum Travel (Agency) to the (Consumer) at Internet address (www.novaraft.com) under the name of itself. Reservation order submitted by the Consumer in electronic environment means that the Consumer have read and signed this agreement (covering all the participants named in the registration form).
II – CANCELLATION – DISCLAIMIING – CHANGES
1-Agency can cancel or postpone the activity in case that there are not enough exact registration relating to the required passenger count or due to bad weather conditions, travel obstacles, strike and lockout in the different fields of the service, terror, war or probability of war, epidemics, quarantine and other extraordinary situations. In this case, participation prices are returned to the Consumer in full within the periods to be announced.
2- In case the Consumer requests a cancellation or change up to 7 days before the start of the service, the full fee is refunded. Consumer accepts and undertakes to pay 50% of the price to Agency if he/she requests cancellation between 3-7 days before the start of the service. If Consumer requests cancellation, he/she agrees and undertakes to pay 100% of the service fee up to 3 days prior to the start of the service and to pay the entire service fee to the Agency.
3-In case the Consumer provides evidence with a report given by a general hospital which proves the self- sickness or death and that of first degree relatives preventing 10-day usual occupation for the reservation, price of the trip is reimbursed in full.
4-If the Consumer doesn’t inform in written that he/she shall participate in the trip lately in case he/she misses the start of the trip, Agency has the right to cancel all reservations made on behalf of the Consumer within 24 hours after the start of the trip. In such cancellations, the Consumer isn’t reimbursed.
5- Consumer may assign the tour to anybody he/she wants until 2 days before the start of the trip. The assignee and the assignor are responsible for the expenses caused by the balance and assignment.
6- In case the cancellation or change of the services purchased as of the date of the reservation by submitting the reasons before mentioned, card commission rate for payments by the credit card shall be reflected to the Consumer regardless of the cancellation, change and reservation date and the reason of the cancellation or change.
7- After signing of the contract, in case the amount paid by the credit card of the Consumer isn’t made to the Agency by the related bank or financial company due to any reason not caused by the Agency, the Consumer is responsible for damages arising out of the service charge and non-payment.
III- GENERAL TERMS
1- Notifications of possible tour cancellation and change by Agency may be done individually to each Consumer, and also it may be announced on its website. In this case, Agency is assumed to meet its liability to notify.
2- After the beginning of the trip in the tour program purchased by the Consumer, except to the extent caused by the actions of 3rd parties or the Consumer and compelling reasons, Agency is responsible for the changes that obviously cause damage to the Consumer. Agency compensates such conditions, either during or after the trip, by giving additional or replacement services or making a reasonable discount in the service charge suitable to the damage in accordance with the terms of Türsab Kütahya Chart. Compensation by the Agency abolishes the rights of the Consumer relating to the refund or indemnification.
3-These terms settled between Agency and the Consumer are accepted and signed by the Consumer by reading and demanding the registration of other people stated to participate in the trip under the same conditions.
4-Services included with the price in tour programs are stated individually. Other services apart from these are subjected to the extra charges.
5-Agency has the right to make changes, without previous notice, in the written tour program, food menu, location and hours of the transfers.
6- In order to benefit from the tour services on the date of the tour reserved, Consumer has to make the payment 1 day before the tour date until 19:00. Reservation of the payments made after this time is valid for next day following the selected date.
7- By making purchase order, the consumer also declares and undertakes that he/she has read the tour package agreement and voucher generated and presented electronically, has understood the actions, and has accepted that he/she has all legal responsibilities of other people on behalf of whom he/she has made purchase order for participating in the trip.
8- Court of Antalya and Enforcement Offices are the exclusive authorities for the settlement of disputes that may arise due the performance of this agreement.
9- It has been agreed that “Privacy Commitment and Security Policy” document is the annex to this agreement and parties have also read and confirmed it along with this agreement.

This Privacy and Personal Data Protection Policy explains the purposes and methods of collecting personal data in tour sales services provided by Antalya Nova Tourism Travel Agency and Trading Limited Company (Novaraft) on its website novaraft.com, and it also explains how this information is used, your rights regarding your collected/stored personal data and the basic principles of Novaraft regarding these subjects.
Basic Principles of Personal Data:
Novaraft acts in accordance with the conditions stated in the legislation regarding the protection and processing of personal data and adopts the principles listed below in order to ensure that processing of personal data is in accordance with the Constitution and the relevant legislation:

Contact information such as name, surname, an e-mail address, telephone number and mail address is requested from the user who makes an online tour reservation through the website of novaraft.com. We do not sell, barter or transfer any of this information to third parties or companies.
Why This Information is Requested:
When booking a tour through our website novaraft.com, there are two options; including Transfer (as we will pick you up from a certain address) or excluding Transfer (in case you come to our facility with your own means). In either case, we need these contact details so that we can contact you. We will contact you about tour day, meeting point, meeting time etc. through this information in order to inform you and request a confirmation. Your contact information could also be used to send GPS location information and to notify you about any possible changes regarding the tour. User contact information could also be used for; internal record keeping, feedback for improving products and services, keeping data statistics, sending promotional e-mails for new products and special offers.
Credit Card Security:
When you book online on our site, your credit card information is transmitted to the bank in encrypted form thanks to the SSL Security Certificate for credit card charges. All credit card transactions and approvals made on our site are carried out online by the relevant bank or card institutions and our company is excluded from the process; and we cannot monitor or store any information such as credit card password by any means. Information entered for membership, purchasing or updating, as well as confidential information about credit and debit cards cannot be monitored by other internet users.
Regulations on Processing Personal Data:
Novaraft.com, an internet service provided by Novaraft, collects your personal data in order to fulfill legal obligations required by:
Article No. 5651 on Regulation of Broadcasts Made on the Internet and Fight against Crimes Committed on Such Platforms and related secondary legislation,
Article No. 6563 on the Regulation of Electronic Commerce and related secondary legislation,

After your personal data is shared with our company, it is within your rights to contact our company in accordance with KVKK article 11, and request to:
a) learn whether your data has been processed, b) ask details of data processing, c) learn the purpose of processing and whether it has been used in accordance with its purpose, d) to request correction if it has been processed incompletely / incorrectly, e) to request its deletion within the framework of the conditions stated in the law.
